Charles A. Luband is a Partner with more than 25 years of experience as a health care regulatory specialist. His primary practice area is Health Care Law, and he is known both for his deep substantive knowledge of key provider reimbursement issues and for his responsiveness to client needs.
With a focus on government program issues, he advises a diverse group of health care clients on a broad variety of federal and state health care regulatory issues, including Medicaid financing issues (the non-federal share of Medicaid payments, including provider taxes, intergovernmental transfers and provider-related donations); specialised Medicaid payments, such as state-directed payments, disproportionate share hospital (DSH) payments, graduate medical education payments and upper payment limit payments; Medicaid Section 1115 and 1915(b) waivers; the 340B Drug Pricing Program; and certain Medicare payment issues, including DSH and cost-reimbursement issues.
He leverages this experience to counsel clients in multiple contexts, including regulatory compliance, corporate transactions, policy advocacy and implementation, as well as administrative and appellate litigation. He represents hospitals and health systems, national and state-level provider associations, medical groups, managed care plans, universities, states, counties, consultants and other health care companies and organisations.
His experience includes developing and obtaining approval for Medicaid payment programs that have provided hundreds of millions of dollars annually to numerous hospitals and physician practices; assisting providers and states in addressing and appealing Medicaid disallowances and disapprovals of Medicaid state plan amendments; counselling a hospital considering reorganising its operations to ensure that new structures accomplish the hospital's mission and retain supplemental payment streams and 340B program eligibility; and providing advice on 340B drug pricing program issues, including the addition of new provider-based child sites, patient eligibility and drug diversion, contract pharmacy arrangements and the group purchasing organisation (GPO) prohibition.
He has also assisted providers in responding to civil investigative demands and investigations regarding Medicaid issues; assisted hospitals and medical schools in developing academic affiliation agreements; and organised a coalition of national health care associations to file an amicus brief and other materials in response to a US Supreme Court case involving the right of providers to sue the state to enforce federal law.
He is a frequent speaker at the American Health Law Association Institute on Medicare and Medicaid Payment Issues and is currently chair of the planning committee for that conference.
His recognition includes being ranked in Chambers USA: America's Leading Lawyers for Business, Healthcare, New York, 2011–present; listed in Best Lawyers in America, Healthcare, 2021–2027; listed as a Recognized Lawyer in the area of Healthcare Service Providers and Insurers by The Legal 500, 2013–2014 and 2022–present; an Acritas Star – independently ranked lawyer, 2019; ranked in Chambers USA: America's Leading Lawyers for Business, Healthcare, District of Columbia, 2009–2010; and named an Outstanding Young Healthcare Lawyer by Nightingale's Healthcare News, 2008.
He is a member of the American Health Law Association, where he has served on the Program Planning Committee of the Institute on Medicare and Medicaid Payment Issues (Member, 2023–2025; Chair 2026–present). He is also a member of the New York State Bar Association and the District of Columbia Bar Association.
Prior to joining Dentons in 2012, he worked at Ropes & Gray LLP in Washington, DC and New York, and in the Washington, DC office of Powell Goldstein LLP. He was also a law clerk for the Honorable Chief Justice Herbert P. Wilkins of the Supreme Judicial Court of Massachusetts.
He holds a JD, cum laude, from Harvard Law School (1996), an MPP from the John F. Kennedy School of Government, Harvard University (1996) and a BA from Brown University (1990).
