Alessandra Denis

Alessandra Denis is Counsel at Dentons. Her primary practice area is Health Care Law, and she guides health care providers and municipalities on regulatory issues and concerns that can hinder their healthcare-related operations if not handled properly.

From representing providers in the negotiation of affiliation agreements to investigating and litigating False Claims Act matters, she offers deep knowledge of the health care industry and regulatory environment.

She consults health care providers regarding compliance with state and federal health care laws, including Medicare and Medicaid reimbursement, fraud and abuse, anti-kickback, physician self-referral, Medicare and Medicaid exclusion laws, and the investigation and disclosure of overpayments. This includes representing large health care systems in negotiations with Medicaid managed care organisations and Affordable Care Organizations, and advising health care providers on Medicare, Medicaid and regulatory compliance requirements for inpatient, outpatient and home health services.

She also advises municipalities and health care providers on Medicaid financing issues (including the authority to make intergovernmental transfers to fund the non-federal share of Medicaid payments and issues concerning provider-related donations) and specialised Medicaid payments, such as disproportionate share hospital (DSH) payments, upper payment limit (UPL) payments and state-directed managed care-related payments.

Her representative experience includes representing public school districts in obtaining dismissal of qui tam False Claims Act complaints alleging submission of false Medicaid claims for health care services to disabled students, and advising the client in related appeals in the Second Circuit; representing a large health care system before the Provider Reimbursement Review Board involving Medicare cost reporting issues, including reimbursement of direct and indirect graduate medical education, disproportionate share hospital payments, and direct physician services for elected teaching hospitals; and conducting internal investigations into potential liability of health care providers under the False Claims Act, the Civil Monetary Penalties Law and state law.

She has also represented large health care systems in negotiations with managed care organisations regarding participating provider and delegated credentialing agreements for Medicare, Medicaid, New York State marketplace and commercial products; advised health care providers and a Medicaid managed care organisation on reporting and payment or recoupment of overpayments to fee-for-service or managed care network and out-of-network providers; represented a health care provider in the drafting and negotiation of participating provider and care management agreements with Affordable Care Organizations; and advised health care providers and municipalities on federal regulatory changes in Medicaid supplemental and state-directed managed care payments, helping draft state legislation and agreements regarding the financing and distribution of such payments.

Her recognition includes being ranked in Chambers USA: America's Leading Lawyers for Business, Healthcare (2024–2025). She is a member of the American Health Law Association, the New York State Bar Association and the American Bar Association.

Prior to joining Dentons in 2025, she was a member of the health care team for over 20 years at a major international law firm. She holds a JD, cum laude, from the University of Michigan (2000) and a BA, magna cum laude, from Columbia University (1995).
