Kenneth J. Pfaehler

Kenneth J. Pfaehler is a Partner in the Washington, DC office, practicing in the firm's Litigation and Dispute Resolution practice with a focus on Securities Law. His practice centers on complex securities, corporate governance, merger and acquisition, and stockholder litigation matters, with extensive experience in defending securities fraud and disclosure litigation, derivative and stockholder claims, and corporate control disputes. He also has deep experience in litigation involving long term care insurance, representing insurance companies in litigation and administrative proceedings concerning rate increases.

Mr. Pfaehler has broad experience in defending securities class actions and is ranked by Legal 500 nationally as a Leading Lawyer for Securities Litigation Defense. Notable representations include winning dismissal with prejudice in a post-Cyan state court Securities Act class action (affirmed on appeal) for electroCore, winning dismissal of the consolidated class action in In re Innocoll Securities Litigation, and winning dismissal for the former CEO of Volkswagen Group of America in the "clean diesel" securities class actions. He has also successfully defended clients in Delaware Chancery Court including a trial victory that cleared a billion-dollar sale transaction, and has represented Genworth Financial, Tailwind Capital, FaZe Clan, and others in high-stakes corporate control litigation. He also represents Indian tribes in a variety of litigation matters, including the Mashpee Wampanoag Tribe and the Cowlitz Tribe.

Ken holds a J.D. from Columbia Law School (1988), where he was a Harlan Fiske Stone Scholar and Managing Editor of the Columbia Human Rights Law Review, an M.A. in English Language and Literature from the University of Virginia (1985), and a B.A., magna cum laude, from the University of Virginia (1983).
