Justine N. Margolis is a Partner and a member of Dentons' Litigation and Dispute Resolution practice. Her primary practice area is Commercial Litigation.
She represents companies facing class actions and complex commercial litigation, and has a strong track record of success in trial and appellate courts. She has experience defending insurers and financial services companies in complex cases in both state and federal courts.
Her practice covers a wide variety of substantive areas, including securities fraud, consumer fraud and deceptive trade practices, coverage disputes, and breach of contract. She also has specialised experience defending companies against allegations regarding actuarial negligence and/or fraud.
Her representative experience includes successfully representing a financial services company and its former officers in a securities fraud class action alleging false and misleading statements regarding an IPO of a mortgage insurance business; obtaining voluntary dismissal of putative class claims against a financial services company alleging wrongful handling of long-term care policy premiums and reserves; and defeating two separate attempts to certify a class and obtaining summary judgment on individual claims in a lawsuit alleging breach of contract and deceptive trade practices with respect to a health insurer's withdrawal from a state insurance market.
She has also represented an insurer in an insurance coverage dispute over the forgery/alteration provision of a fidelity bond, defended a major life insurer against breach of contract, bad faith and vicarious liability claims related to universal life policies, and managed large-scale, cross-border electronic discovery for two major companies involving data privacy issues. She co-chaired a six-day federal trial on behalf of a pro bono client who alleged violations of his constitutional rights.
She is a co-author of "AI's Growing Role in Insurance Spurs Regulatory Response" (Dentons Insights, October 2024) and has spoken on topics including AI and healthcare, and cyber, data privacy and AI issues relevant to the insurance industry.
She holds a JD, Order of the Coif, from Washington University (2006) and a BA in Biology and Spanish from Washington University (2002).
