Ken has been involved in numerous significant matters, including representing the secured lender and DIP lender in a substantial chapter 11 for Mountain West REIT; successfully defending Skyworks‑Global against an involuntary chapter 11 petition; representing secured creditors, DIP lenders, and a bidder at auction in the chapter 11 case of CS Mining, a substantial copper mine development; representing an ad hoc committee of second‑lien secured creditors owed several hundred million dollars by Pivotal Promontory (Utah 7000, L.L.C.); and representing the examiner with expanded powers in the chapter 11 reorganization of Tri‑Valley Distributing Company, a large distributor of oil products and owner of 80 convenience stores. He has also been engaged as an expert witness on insolvency and commercial law matters and issues crucial bankruptcy and New York legal opinions in commercial transactions.

Ken holds a J.D., cum laude, from Brigham Young University, J. Reuben Clark Law School (1982), where he was Order of the Coif, as well as an M.A. in American History and a B.A. in History, summa cum laude, from Brigham Young University. He was a Senior Fulbright Scholar at the University of Helsinki Faculty of Law in 1985.

He is a Fellow of the American College of Bankruptcy (10th Circuit Regent, 2018‑2021) and has been recognized in The Best Lawyers in America (1995‑2026), named Lawyer of the Year in Bankruptcy and Creditor Debtor Rights / Insolvency and Reorganization Law (2024) and Litigation – Bankruptcy (2019), and listed in Lawdragon 500 Leading U.S. Bankruptcy and Restructuring Lawyers (2020).
